Terms of Use
of the JANSSEN 4 PATIENTS website

I. Definitions

  1. Website – an online platform functioning at janssen4patients.com through which the Functionalities dedicated to the Users from local markets are offered:
    1. In Poland, by Janssen-Cilag Polska Sp. z o.o., ul. Iłżecka 24, 02-135 Warsaw;
    2. In Slovakia, by Janssen, divízia Johnson&Johnson s.r.o., CBC III, Karadžičova 12, 821 08, Bratislava;
    3. In the Czech Republic, by Janssen-Cilag s.r.o., Karla Engliše 3201/6, 150 00 Praha;
    4. In Hungary, by Janssen-Cilag Kft., Nagyenyed u. 8-14, 1123 Budapest;
    5. In Romania, by Johnson & Johnson România SRL, Str. Tipografilor nr. 11-15, 013714 Bucureşti;
    6. In Slovenia, by Johnson & Johnson d.o.o., Šmartinska 53, 1000 Ljubljana;
    7. In Croatia, by Johnson & Johnson S.E. d.o.o., Oreškovićeva 6h, 10010 Zagreb.
  2. Functionalities – the given possibilities and forms of using the Website, consisting in particular in sharing:
    1. Information about healthcare facilities providing healthcare services, as per the particular diseases;
    2. Information about patients’ organizations, as per the particular diseases;
    3. Information about events organized by patients’ organizations, as per the particular diseases;
    4. Materials, as specified in detail in section VI.
  3. Material – a single material, including an audio-visual material, shared for free on the Website in such a way that every User of the Website can access it at the place and time of their choice.
  4. User – every person that visits the Website and is a recipient of the Materials published on the Website, as well as any entity that can use the Functionalities in accordance with section VI.
  5. Janssen Group – the Johnson&Johnson group of companies, which includes Janssen-Cilag Polska Sp. z o.o. of Warsaw, ul. Iłżecka 24, 02-135 Warsaw.
  6. Local Operator – an individual company belonging to the Janssen Group that is responsible, under these Terms of Use, for the Functionalities of the Website and its proper functioning on the relevant local market, i.e.:
    1. On the Polish market: Janssen-Cilag Polska Sp. z o.o. of Warsaw;
    2. On the Czech market: Janssen-Cilag s.r.o. of Prague;
    3. On the Slovak market: Janssen, divízia Johnson&Johnson s.r.o., CBC III, of Bratislava;
    4. On the Hungarian market: Janssen-Cilag Kft. of Budapest;
    5. On the Croatian market: Johnson & Johnson S.E. d.o.o. of Zagreb;
    6. On the Slovenian market: Johnson & Johnson d.o.o. of Ljubljana;
    7. On the Romanian market: Johnson & Johnson România SRL of Bucharest.

II. General provisions

  1. These terms of use (the “Terms of Use”) specify the rules of the Users using the Functionalities and the responsibility of the Local Operators for the Website on the particular local markets, as well as the obligations of Janssen Polska following from running and coordinating the Website.
  2. The Local Operators shall use and manage the Website on the relevant local market in accordance with the applicable legal regulations, social and moral norms, best practices, and these Terms of Use.
  3. The owner and coordinator of the Website is Janssen-Cilag Polska Spółka z ograniczoną odpowiedzialnością of Warsaw, ul. Iłżecka 24, 02-135 Warsaw, entered into the Register of Businesses, a part of the National Court Register kept by the District Court for the capital city of Warsaw in Warsaw, Division XIII (Commercial Cases and National Court Register Cases), under number 0000143626, NIP (tax identification number): 5222665719, REGON (statistical number): 015296339, e-mail address: info@janssen.pl (“Janssen Polska” or the “Coordinator”).
  4. Through the Website, Janssen Polska and the Local Operators shall provide the Users with access to the Materials and an opportunity to use the Website’s Functionalities, in accordance with these Terms of Use.
  5. The Local Operators shall be liable towards local Users, in particular for the incorrect operation of the Website’s Functionalities, in accordance with these Terms of Use.
  6. The Users may access these Terms of Use at any time via a link located at the bottom of the Website, which is available on every page of the Website, and print them out.
  7. The Website is available in the language versions of all Local Operators and in English and is dedicated to the Users as per the location in which they are using the Website.
  8. Neither the Local Operator nor Janssen Polska are Internet providers. In order to use the Website, a device with access to the Internet is necessary. The Functionalities offered on the Website can be used in full, provided that the Local Operator meets the relevant technical requirements specified in section VIII. The Local Operator shall be exclusively liable for ensuring compliance between his computer system and the Website.
  9. Janssen Polska reserves the right to suspend, cancel, or modify the Functionalities offered on the Website for legal or technical reasons, including:
    • Privacy or data protection requirements or other legal issues related to the contents or the functioning of the Website;
    • Technical difficulties related to the functioning of the Website or the Internet.
  10. The Local Operator and Janssen Polska shall not be liable for Website unavailability for reasons beyond their control and due to unexpected circumstances.
  11. Janssen Polska reserves the right to suspend or decommission the Website at any time and for any reasons.
  12. The fact that third party websites contain links to the Website shall not mean that Janssen Polska or the Local Operator permits or is liable for the functioning or the contents of such third-party websites.
  13. Janssen Polska and the Local Operator shall not be liable for any negligence in the performance of their duties under these Terms of Use if caused by reasons they are not responsible for.
  14. Janssen Polska and the Local Operator shall not be liable for the potential losses or damage suffered by the Users as a result of force majeure, power cuts, labour disputes, legal regulations, negligence or inaction of authorities, telecommunications breakdowns, or any delays or breakdowns caused by third parties. In such cases, Janssen Polska reserves the right to cancel or suspend the functioning of the Website without any liability on this account.
  15. Janssen Polska and the Local Operator shall not be liable for breakdowns of the devices or software used by the Users that will prevent Users from accessing the Website or contacting the Website, regardless of their location and place of administration.
  16. The relevant Local Operators shall be exclusively liable for the information and Materials published on the local versions of the Website listed in section I.1.

III. The Website’s Privacy Policy

  1. The privacy policy can be accessed via the Privacy Policy link.

IV. Rules of using the Website and prevention of abuse

  1. The Website should be used by the Users for the purposes in the manner specified in these Terms of Use. This means that the Users shall not use the Website for any other purposes or in any other manner.
  2. The Users shall not employ dishonest methods in using the Website. Furthermore, it is forbidden for the Users to take any actions that could result in interrupting or disturbing the functioning of the Website.
  3. Janssen Polska reserves the right to suspend or refuse access to the Website or parts of it if the User’s actions are in violation of these Terms of Use, legal regulations, principles of social co-existence, or good customs.

V. Intellectual property

  1. Any and all copyrights, trademarks, and other intellectual property rights concerning the Website or used thereon shall rest exclusively with Janssen Polska or the Local Operator. Without prior written consent from Janssen Polska or the relevant Local Operator, nobody shall copy, disseminate, publicly present, or create any derivative works on the basis of the Website or any other materials obtained from the Website.
  2. It is forbidden to use the intellectual property rights resting with Janssen Polska or the Local Operator for purposes other than strictly related to using the Website in accordance with these Terms of Use.

VI. Services provided on the Website

  1. Through the Website, Janssen Polska shall offer in particular the following Functionalities to the Users:
    1. As part of sharing information about healthcare facilities providing healthcare services, as per the particular diseases—publishing on the Website information about healthcare facilities and their activity, including contact data, after prior verification by the Local Operator of the report concerning the given facility, i.e. whether the reported data is true and in compliance with the policy of the Janssen Group;
    2. As part of sharing information about patients’ organizations, as per the particular diseases—publishing on the Website information about patients’ organizations and their activity, including contact data, after prior verification by the Local Operator of the report concerning the given organization, i.e. whether the reported data is true and in compliance with the policy of the Janssen Group;
    3. As part of sharing information about the events organized by patients’ organizations—publishing on the Website information about the given event, as reported by the above organizations, after prior verification by the Local Operator of the report, i.e. whether the reported data is true and in compliance with the policy of the Janssen Group;
    4. The possibility of submitting and publishing on the Website a new Material after its prior verification by the relevant Local Operator in terms of it being true and in compliance with the policy of the Janssen Group;
    5. Other services the terms of use of which Janssen Polska shall specify separately, in the form of an appendix to these Terms of Use.
  2. The verification of the reports referred to in sections VI.1.1–VI.1.3 shall take place exclusively by means of the form available on the Website, to be filled out by the User in accordance with the rules specified in this form (the “Report”).
  3. The Reports shall be verified by the Local Operator immediately, not later than within 14 days of receiving a correctly filled-out form.
  4. The Local Operator shall have the right to verify the given Report negatively and to refuse to publish on the Website the information contained in the Report if the verification referred to in sections VI.1.1–VI.1.3 shows that the data is untrue or incomplete or that the Report is in discordance with the policy of the Janssen Group or if the Report violates these Terms of Use, legal regulations, the principles of social co-existence, or good customs.
  5. If the Report is verified positively, a link to the User’s website may be published on the Website, together with the basic contact data or the data of the given event and the logo of the User; the publication by Janssen Polska or by the Local Operator of a logo or other markings on the Website shall not be a violation of any intellectual property rights of the User.
  6. Submitting a Material and publishing it on the Website shall be possible after prior verification, as specified above, on the basis of individual arrangements with the relevant Local Operator.
  7. If any works or other intellectual property rights of the User are published on the Website, it shall be deemed that the User granted Janssen Polska the right to use them on the Website.

VII. Complaints

  1. Complaints concerning the Website may be submitted in any form, including to the e-mail address of the relevant Local Operator, i.e. 
  2. The complaint should contain at least the first and last name or the business name of the complaining party, as well as a detailed description and reason for the complaint.
  3. The complaints shall be examined immediately after receiving them, in accordance with the sequence of their submission, not later than within 14 days of the relevant Local Operator receiving the given complaint.
  4. The party submitting the complaint shall be informed about the result of the examination of the complaint via the same channel that was used to submit the complaint or by means of a letter sent to the address provided in the complaint.

VIII. Technical requirements

Proper use of the Website is possibly only if the User’s ICT system meets the following minimum technical requirements:

  1. The User’s computer/tablet/smartphone has to be connected to the Internet through a line with a minimum ISDN bandwidth of 1.5 Mb/s.
  2. The User has to use the latest versions of one of the following browsers: Google Chrome, Internet Explorer, Mozilla Firefox, or Safari, with support for the current Adobe Flash Player extension switched on.
  3. The User’s device has to be equipped with a 2.33 GHz or faster x86-compatible processor or a 1.6 GHz or faster Intel® Atom™ processor for netbooks, 1 GB RAM, and a sound card with correctly plugged-in speakers.

IX. Personal data processing

The Users’ data shall be processed in accordance with the applicable local legal regulations, exclusively to the extent necessary to verify the Report. The data controllers shall be: for the Polish market—Janssen-Cilag Polska Sp. z o.o. of Warsaw, ul. Iłżecka 24, 02-135 Warsaw; for the Czech market—Janssen-Cilag s.r.o., Karla Engliše 3201/6, 150 00 Praha; for the Slovak market—Janssen, divízia Johnson&Johnson s.r.o., CBC III, Karadžičova 12, 821 08, Bratislava; for the Hungarian market—Janssen-Cilag Kft., Nagyenyed u. 8-14, 1123 Budapest; for the Romanian market—Johnson & Johnson România SRL, Str. Tipografilor nr. 11-15, 013714 Bucureşti; for the Slovenian market—Johnson & Johnson d.o.o., Šmartinska 53, 1000 Ljubljana; for the Croatian market—Johnson & Johnson S.E. d.o.o., Oreškovićeva 6h, 10010 Zagreb. Provision of personal data is voluntary, but necessary to use the Website. The persons providing their personal data shall have the right to access this and correct it.

X. Final provisions

  1. The law governing the rights and obligations of the Users shall be the law of the jurisdiction in which the Local Operator responsible for running the Website on the given local market has its registered office, i.e.:
    1. For Users from Poland: Polish law;
    2. For Users from the Czech Republic: Czech law;
    3. For Users from Slovakia: Slovak law;
    4. For Users from Hungary: Hungarian law;
    5. For Users from Croatia: Croatian law;
    6. For Users from Slovenia: Slovenian law;
    7. For Users from Romania: Romanian law.
  2. All of the matters involving a User and Janssen Polska shall be governed by the Polish law.
  3. Janssen Polska reserves the right to assign to a third party some or all of the rights and obligations resulting from these Terms of Use and from the functioning of the Website. Without written consent from Janssen Polska, the User shall not assign or waive any rights and obligations resulting from these Terms of Use or from using the Website.
  4. If the given Terms or Use become invalid or ineffective in view of the applicable legal regulations, this shall not affect the validity and effectiveness of the other Terms of Use.
  5. Janssen Polska may refuse to continue providing the User with access to the Website if the User violates these Terms of Use or if Janssen Polska concludes that the actions of the User could result in liability of any of the companies belonging to the Janssen Group or in liability of a third party.
